Intellectual Property Licensing and Transactions
Weintraub Tobin’s Intellectual Property practice group has many years of experience licensing intellectual property and handling other transactions relating to the development, management and protection of valuable intellectual property assets. Our attorneys help maximize our clients’ return on intellectual property rights, while ensuring that their licensing programs do not violate antitrust or unfair competition laws or render their IP rights unenforceable.
Weintraub Tobin attorneys have experience in all aspects of licensing including traditional patent, trademark and copyright license agreements involving usage rights and royalty arrangements for products and services in the United States and abroad. We have also drafted and negotiated many high-value commercial contracts related to matters such as to complex, multi-party technology development, manufacturing and distribution deals, value added resellers (VARs), mergers and acquisitions, academic research, professional services and non-disclosure of confidential information.
Additionally, our attorneys have significant experience drafting and negotiating U.S. government contracts under the Federal Acquisition Regulations (FAR) and the Department of Defense Federal Acquisition Regulation Supplement (DFARS) involving agreements both as a prime contractor and a subcontractor. With a particular focus on technical data rights and computer software, we have handled term sheets, memorandums of understanding (MOUs), teaming agreements and final contracts involving the Department of Defense, federal civilian agencies and foreign governments.
