Darrin’s environmental practice includes counseling owners and operators with respect to regulatory compliance and representing clients in negotiations and disputes with state and local enforcement agencies. Darrin represents owners and operators of sites regulated by the California Integrated Waste Management Board, California Department of Toxic Substances Control, Regional Water Quality Control Boards and other state, regional or local agencies regarding all aspects of site compliance and remediation. Darrin’s practice involves CERCLA, RCRA, and Hazardous Waste Control Act laws and regulations.
Darrin was selected for inclusion in the Northern California Super Lawyers listing as a Rising Star for 2009, 2010 and 2011.
Prior to joining the Weintraub firm in 2005, Darrin worked for a large West Coast law firm where he managed all facets of complex civil litigation, with specific emphasis on competitive business disputes and environmental cases involving CERCLA, RCRA and Underground Storage Tank laws and regulations. Darrin has extensive experience representing clients in responding to cease and desist orders, cleanup and abatement orders and waste discharge requirements.
Representative Matters:
- Counsel for lessee in a dispute involving the interpretation of a commercial lease, which resulted in a $150,000 verdict for the client, including attorneys’ fees, and a favorable lease interpretation.
- Buyer’s counsel in binding arbitration of commercial real estate purchase agrewhich resulted in judgment requiring seller to specifically perform contracted to pay buyer’s attorneys’ fees and costs.
- Counsel for lessee in a commercial lease dispute, which resulted in a verdict for the lessee exceeding $300,000 and confirming lessee’s 99-year lease over property.
- Successfully defended operator in an administrative action initiated by the California Integrated Waste Management Board (CIW, MB), resulting in a cease and desist order.
- Counsel for owner in large multi-party CERCLA action resulting in finding of joint liability against local government and favorable settlement for owner.
